The agreement between families and Nannyeze Ltd (company no. 10938427).
This Terms and Conditions Contract is between the employer/Family, herein after to be called the "FAMILY” and Nannyeze (10938427) herein after to be called the “AGENCY”.
The "FAMILY” is defined as a person(s) who approaches Nannyeze Ltd either via verbal and/or written instruction and requests Nannyeze Ltd to assist and introduce the "FAMILY” to a Nanny, (or any other childcare professional requirement), herein after to be called the ‘Candidate,’ for the purpose of employment.
The AGENCY agrees to screen and refer qualified persons, primarily but not limited to, those who have had a previous relationship with the AGENCY.
The AGENCY will collect detailed information from each prospective AGENCY NANNY regarding experience, qualifications, and other items relevant for employment with the FAMILY. The AGENCY will ensure that it obtains at least two verified references from the AGENCY NANNY to determine the AGENCY NANNY's qualifications and potential suitability for referral to the FAMILY. The AGENCY will complete criminal background checks, sex offender registry and driving record information on an AGENCY NANNY before referring the AGENCY NANNY to the Family.
The AGENCY will also interview the AGENCY NANNY before she/he is referred to the FAMILY. For each referral, the AGENCY will disclose to the FAMILY a detailed file that documents the screening process and the results.
The FAMILY agrees to provide accurate and complete information to the AGENCY regarding its expectations for an AGENCY NANNY and the terms and conditions of employment.
It is the responsibility of the FAMILY to decide whether to engage the services of the NANNY. The FAMILY will review the file provided by the AGENCY, interview the candidate and, if desired, contact references.
If the FAMILY wishes to engage an AGENCY NANNY referred by the AGENCY, the FAMILY agrees to enter into a written agreement (“AGENCY PLACEMENT AGREEMENT”) with the AGENCY for the services provided by the AGENCY NANNY. Such agreement will not limit the AGENCY, AGENCY NANNY or the FAMILY’s right to terminate employment within the agreed period of notice.
The FAMILY accepts the responsibility for making a decision to engage the services of the AGENCY NANNY referred by the AGENCY. The FAMILY will make such a decision after reviewing all the relevant information obtained by the AGENCY on the candidate and after conducting their own interview with the candidate. At the time an employment offer is made, the FAMILY agrees that the AGENCY’s background work is complete and satisfactory.
The FAMILY understands and agrees that the AGENCY does not guarantee the performance of the selected AGENCY NANNY or the accuracy of information provided by the AGENCY NANNY or her/his references.
Assuming the AGENCY has not withheld relevant information and has not falsified information presented to the FAMILY, the FAMILY agrees to release and discharge the AGENCY from any claims for damages or losses that might result from the employment of an AGENCY NANNY referred by the AGENCY.
The FAMILY agrees to pay a referral fee prior to initiation of the nanny referral process. The referral fee is non-refundable.
If the FAMILY wishes to engage the services of an AGENCY NANNY referred by the AGENCY, the FAMILY agrees to pay a placement fee to the AGENCY for the AGENCY NANNY’s on-going services. The details and terms of the placement fee applicable will be set out in the AGENCY PLACEMENT AGREEMENT.
For the next two years, the FAMILY agrees not to employ, or refer to other parties, any AGENCY NANNY without the payment of the full referral or placement fee as per the terms of this agreement or any subsequent AGENCY PLACEMENT AGREEMENT. The FAMILY also agrees not to employ, or refer to other parties, such persons for temporary periods (such as babysitting) without paying the AGENCY's fees for such services.
